These Terms of Use ("Terms") constitute a legally binding agreement between you and UNNERFABLE LTD ("Company," "we," "us," or "our"), concerning your access to and use of the Bandospottr mobile application ("App") and any related services (collectively, the "Services").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the App.
We reserve the right to modify these Terms at any time. We will notify you of changes by updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the updated Terms.
You must be at least 18 years of age or the age of majority in your jurisdiction to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under the required age, you must not use the App.
To use certain features of the App, you must create an account by providing a username, email address, and password. You agree to:
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Bandospottr is a location-based guessing game ("BandoGuesser") where users attempt to identify abandoned locations from satellite imagery. The App includes:
The App uses a virtual currency called "Coins." Coins can be earned through gameplay (solo rounds, multiplayer matches, daily check-ins, watching advertisements) or purchased with real money through in-app purchases. Coins have no real-world monetary value and cannot be exchanged, transferred, sold, or redeemed for real currency, goods, or services outside the App.
Coins may be used to purchase virtual cosmetic items within the App. Cosmetic items are purely visual and do not affect gameplay or provide competitive advantages. All cosmetic purchases are final and non-refundable, except as required by applicable law.
We offer an optional premium subscription ("Bandospottr Premium") that provides benefits including but not limited to: ad-free experience, increased daily coin rewards, and access to exclusive cosmetic items. Subscription terms, pricing, and billing are managed through the Apple App Store or Google Play Store. You may cancel your subscription at any time through your device's subscription management settings. Refunds are subject to the policies of Apple or Google, as applicable.
The App features a randomized reward mechanic ("Spin the Wheel") where users spend Coins for a chance to receive various rewards including Coins, cosmetic items, or location reveals. The odds of receiving each reward type are predetermined and the outcomes are generated randomly. Spin the Wheel is an entertainment feature using virtual currency only and does not constitute gambling.
All purchases of Coins and virtual items are final. We do not offer refunds for any virtual goods purchased within the App, except as required by applicable law or the policies of Apple or Google.
The App displays advertisements provided by third-party advertising networks, including Google AdMob. By using the App, you consent to the display of advertisements. Premium subscribers may have an ad-free experience as described in the subscription benefits.
You may optionally watch rewarded advertisements to earn additional Coins. Rewarded ads are entirely voluntary and subject to daily limits.

Certain features of the App (such as Location Reveals) require access to your device's location services. Location data is used in real-time to provide the requested feature and is not stored on our servers beyond the duration of the request. You can disable location access at any time through your device settings, but this may limit certain App features. For more information, please see our Privacy Policy.
The App may send push notifications related to gameplay events (match found, your turn, match results), daily rewards, and engagement reminders. You can manage or disable push notifications at any time through your device settings.
The App includes a limited post-game chat feature that is available for a short window (90 seconds) after a multiplayer match concludes. Messages are limited to 200 characters. You agree to use this feature responsibly and not to send abusive, threatening, or inappropriate messages. We reserve the right to monitor chat messages and take action against users who violate these Terms.
Users may report game locations that appear incorrect or are no longer abandoned. Reports are reviewed by our team and may result in the removal of locations from the game. Abusing the reporting system may result in account suspension.
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, pixel art, character designs, game mechanics, audio, and the design, selection, and arrangement thereof) are owned by UNNERFABLE LTD, its licensors, or other providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
The App uses Google Maps Platform APIs to display satellite imagery. Your use of map features is additionally subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IMPORTANT: The locations featured in the BandoGuesser game and revealed through the Location Reveal feature are for entertainment and informational purposes only. We do not encourage, endorse, or recommend visiting any abandoned or derelict locations. Visiting such locations may be illegal (trespassing), dangerous, or both. You assume all risk associated with any decision to visit locations featured in or discovered through the App. We are not responsible for any injury, damage, legal consequences, or other harm resulting from visiting any location.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UNNERFABLE LTD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
Our total liability to you for all claims arising from or relating to the use of the App shall not exceed the amount you have paid to us in the twelve (12) months prior to the claim.
You agree to defend, indemnify, and hold harmless UNNERFABLE LTD and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your violation of any applicable law or regulation.
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination:

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be resolved in the courts of Limassol, Cyprus.
For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws in your country of residence.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and UNNERFABLE LTD regarding the use of the App and supersede all prior agreements and understandings.
